Kausik (Rejected) CRM (NDPS) 136 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hili Police Station Case No. 91 of 2025 dated 28.04.2025 under sections 20(b)(ii)(C)/27A/28 of the NDPS Act read with Sections 132/221 of the BNS, 2023.

Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused and there is only recovery of 2 Kgs. 64 Gms. of Ganja. Petitioner is in custody since 11.05.2025 and as such she may be released on bail on any stringent condition. On the other hand, learned advocate for the State submits that initially 93 Kgs. 400 Gms. of Ganja were recovered from one co-accused and pursuant to his statement the petitioner was apprehended and from his house another 2 Kgs. 64 Gms. were recovered. It has been further submitted that the petitioner has antecedents.

Having considered the materials appearing against the petitioner and the chain of circumstances, I am of the view Section 37 of the NDPS Act is attracted.

As such the prayer for bail of the petitioner is rejected. Accordingly, CRM (NDPS) 136 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
