Mr. Sabyasachi Chatterjee Mr. Badrul Karim Mr. Aritra Ghosh Ms. Monalisa Sinha ...for the Petitioner Ms. Sayantanee Bhattacharjee ...for the State Mr. Subhasish Pachhal Mr. Abhishek Chakraborty ...for Respondent No.4 In terms of the order dated 21st January, 2025 learned advocate representing Salkia Vikram Vidyalaya, Howrah being respondent no.4 on instruction submits that the school authority though received application from the petitioner seeking appointment on compassionate ground due to death of petitioner's father on 3rd September, 2018 but inadvertently same was not forwarded to the District Inspector of Schools (S.E.), Howrah being respondent no.3 for taking further steps. On perusal of the writ petition, it also appears that after death of father of the petitioner on 3rd September, 2018 application seeking appointment on compassionate ground is made in the month of November, 2018 and same was received by the school authority on 20th November, 2018.

Since it is submitted on behalf of the school authority that till date application seeking appointment on compassionate ground has not been forwarded, respondent no.4 is directed to forward the application of

the petitioner seeking appointment on compassionate ground to respondent no.3 by seven (7) days from date. On receipt of such application along with connected papers from the school authority, District Inspector of Schools (S.E.), Howrah being respondent no.3 is directed to take decision whether petitioner is eligible to be recommended to the School Service Commission for being appointed under died-in-harness category. The District Inspector of Schools (S.E.), Howrah is directed to take decision by eight (8) weeks from the date of receipt of application and other documents from the school authority and the decision shall be communicated to the petitioner by ten (10) days thereafter.

With the aforesaid directions, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
