06-08-2021 ct no. 13 Sl.6 sp WPA 1434 of 2021 Pronobesh Pakhira -VersusState of West Bengal & Ors.

(Via Video Conference) Mr. Kallol Bose, Mr. Lakshminath Bhattacharya ...for the petitioner Mrs. Sima Adhikari, Mrs. Kakali Naskar ....for the State Mr. A. Bhattacharya ....for the respondent nos. 13 and 14 Mr. Prasenjit Mukherjee ...for the respondent no. 16 The only question that needs consideration is as to whether an FIR should be lodged into the complaint filed by the writ petitioner.

Reports have been received from the State.

The matter was argued at length and judgments cited by the respective parties.

The issue appears to be rather academic as on date. A substantial period of time has elapsed since filing of the writ petition. The report of the ADSR, Amta, prima facie found that that there may have been some forgery committed. This Court does not express any opinion on the same. Reserving the arguments and counter-argument in law made by the parties to be decided on another occasion, the Officer-in-Charge, Amta Police Station shall forthwith register the FIR and

commence the investigation into the complaint of the petitioner dated 22.12.2020 and the G.D.

Entry dated 19.12.2020.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
