1. The affidavit of compliance filed on behalf of the alleged contemnor Mr. Siddhartha Majumdar, Chairman of the West Bengal Central School Service Commission is accepted with apology and the same is taken on record.

2. The learned Counsel for the State submits that the West Bengal Board of Secondary Education is the appointing authority, although, the said Board is not a party in the writ petition and we have not directed the Board per se, to give appointment. It is merely consequential that West Bengal Central School Service Commission has already declared the vacancy and recommended the name of the petitioner for appointment by the Board.

3. Under such circumstances, we dispose of the contempt application by directing the Board to take immediate steps on the basis of the declaration of vacancy recommended by the Chairman, West Bengal Central School Service Commission

as expeditiously as possible and preferably within a period of two weeks from the date of communication of this order.

4. In case of any inconvenience in carrying out this direction, it would be open for the Board to apply for modification of this order.

5. This order shall be immediately communicated to the President, West Bengal Board of Secondary Education for information and doing the needful.

6. With the aforesaid direction, the appeal is disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
