Mr. Krishna Pada Santra ....for the petitioners Mr. Satyajit Mahata ....for the State Affidavit of service filed on behalf of the petitioners is taken on record.

Wife and two daughters of the deceased Headmaster have approached this Court with the present writ petition claiming interest on delayed payment of gratuity. Headmaster died-in-harness on 31st August, 2021. Thereafter Pension Payment order was issued on 19th September, 2023 sanctioning family pension in favour of wife of deceased Headmaster and proportionate amount of gratuity was released in favour of wife and two daughters of the deceased Headmaster.

State respondents are represented by learned advocates.

Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioners on gratuity from the date following the date of death of the Headmaster till the date of release of gratuity, within a period of eight weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.
