Counsel for the petitioner submits that the principal accused/respondent no.
was absconding for 11 years and has only recently been taken into custody.
Counsel for the State submits that charge sheet has been put to committal, and that charges have already been framed.
The trial has commenced.
Counsel for the petitioner submits that the fingerprints on the gamcha used for strangulation of the victim should be compared with those of the accused/respondent no. 4.
This Court notes that the same is the subject matter of the trial and the Sessions Judge already has power under Section 311 of the Cr. P. C. to call for further evidence and/or witness or documents.
It is also submitted that the brother-in-law of the accused/respondent no. 4 is also involved in the crime.
With the aforesaid observations, the writ petition is disposed of.
