... petitioners Mr. Bidyut Kumar Roy, Sr. Advocate Ms. Rita Datta ...for the State The revisional application was preferred challenging the proceedings arising out of Khargram Police Station Case No.167 of 2009 dated 03.06.2009, wherein the petitioners approached this Court immediately after filing of the charge-sheet. Records of the revisional application reflect that till date, the revisional application has not been admitted, although, the same was filed in the year 2011. The subject-matter of the case relates to offences under Sections 498A/506/323/34 of the Indian Penal Code.
Having regard to the stage at which the petitioners approached this Court prior to the documents under Section 207 of the Code of Criminal Procedure, being served upon them by the State, I am of the view that the revisional application was preferred at a premature stage and as such, no interference is called for by this Court.
Consequently, C.R.R.38 of 2011 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
