Chowdhury Ms. Tripty Panday Mr. Tarun Kumar Poddar ...for the petitioners Mr. Pravash Bhattacharyya Mr. Abhishek Verma ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. There is no other material available against the petitioners except for the statement of co-accused. It is alleged that some persons committed burglary in a shop and took away about Rs. 13 lakhs. About nearly Rs. 11 lakhs was recovered from the arrested accused. The petitioners have been falsely implicated in this case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the statements of the witnesses and other materials available in the case diary. He refers to a hotel register to show that the present petitioners were staying at the same hotel in Kolkata at the relevant time along with other co-accused. CCTV footages are available showing who were the persons who entered into the shop. The arrested accused have

already been identified. The present petitioners, if arrested, would be identified.

Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioners is rejected.
