Petitioner is aggrieved by the fact that his information furnished with Kolaghat Police Station has not been taken care of. The said representation was dated 08.01.2024. More than 13 months have passed since the information was furnished to the police station.

Learned advocate for the private respondent no.8 submits that there has been a long standing dispute between the petitioner and the private respondent no.8 and number of cases are pending also.

Learned advocate for the State is present.

In view of the nature of accusations made by the petitioner, I grant liberty to the petitioner to approach the jurisdictional court under Sections 175

(3) of the BNSS/156(3) of Cr.P.C. Learned Magistrate would act in accordance with the relevant provisions of law. It is directed that the learned Magistrate would first assess whether a cognizable offence is made out thereafter also assess whether a case for investigation is made out and then only pass necessary directions. With the aforesaid observations, WPA 1139 of 2024 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
