This is an application under 439(2) of the Code of Criminal Procedure with a prayer for cancellation of bail in the order dated 22.11.2017 passed by the learned Additional Chief Judicial Magistrate, Barrackpore in GR No.7289 of 2017 arising out of Naihati Police Station Case No. 774 of 2017dated 31.10.2017 under Section 420/406 of the Indian Penal Code, 1973, inter alia, on the ground stated in the petition that after having been granted bail the opposite party/accused is creating chaos and has become furious.
I have gone through the materials on record and in consideration of the order for granting bail, I do not find any ground for cancellation of the bail as the opposite party/accused was admitted on bail for the reason that he had surrendered before the Court voluntarily. However, I make it clear that the learned Magistrate will expedite the case in view of the fact that the chargesheet has already been submitted and would compel the
attendance of the opposite party/accused on the fixed dates of trial.
In the context, the application for cancellation of bail being CRM 29 of 2018 is disposed of.
