The petitioner qualified in the TET examination.

The West Bengal Board of Primary Education published a notification for recruitment of primary teachers on 23rd December, 2020. The eligible age limit as prescribed in the said notification is between 18 years to 40 years on the 1st day of January of the year of advertisement i.e. 01.01.2020.

Admittedly, the petitioner became over aged on the 1st day of the year of the advertisement.

The petitioner submits that as he was within the age limit when he qualified in the TET 2014 examination, accordingly, he ought to be given a chance to appear and participate in the recruitment process.

The notification for recruitment clearly mentions that applications were invited from TET 2014 qualified trained candidates who were of a particular age. The petitioner was over aged in terms of the eligibility criteria as fixed in the notification for recruitment.

The petitioner does not fall within the reserved category and accordingly, do not have a chance for age relaxation.

In view of the above, no relief can be granted in favour of the petitioner in the present writ petition. The writ petition fails and is hereby dismissed. Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
