1. The instant appeal was preferred against an order THURSDAY Court : 08 Item : DL-41 Matter : FMA Status : DD Bench ID : 266006 Transcriber : NANDY of rejection of the claim of the petitioner on the ground that the relevant Rules does not permit regularization or absorption of a service which is purely contractual in nature.

2. When the matter is taken up today, it is informed that the appellant has attained the age of superannuation.

3. In view of the aforesaid subsequent event discerned in course of hearing, the original cause of action has elapsed and no longer surviving and, therefore, there is no need to keep the appeal pending.

4. Accordingly, FMA of stands dismissed as infructuous.
