Petitioners complain that they have purchased the property and are unable to cultivate the land as disturbance has been created at the behest of the private respondents.

Learned advocate for the State has submitted a report. Learned advocate submits that as and when representation was submitted on and from September, 2023, police authorities had been vigilant. On an assessment, police authorities also drew up proceedings under Section 107/116 of the Code of Criminal Procedure.

Mr. Mostafa, learned advocate appearing for the private respondents submits that the land has been recorded in the name of the respondents. So far as the right, title and interest of the property is concerned, this Court will not enter into the said domain and it would be the exclusive domain of the civil court. However, having considered that the petitioners and the private respondents are at loggerhead, the police authorities would keep a strict vigil and ensure that no breach of peace or tranquility takes place or any untoward incident results because of inimical relationship existing between the petitioners and the private respondents.

With the aforesaid observations, WPA 1153 of 2024 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
