1. The grievance of the petitioner is directed against non-consideration of a representation dated 20th June, 2024 issued to the District Engineer, Kolkata South, CESC Limited. It is submitted on behalf of the petitioner that notwithstanding receipt of this representation, CESC authorities have taken no steps in the matter.

2. On behalf of the private respondent it is submitted that there are private disputes by and between the petitioner and the private respondent and the same are pending before a competent Civil Court. It is also submitted on behalf of the private

respondent that they are enjoying electricity since 2022.

2. In view of the above circumstances, WPA/1393/2026 stands disposed of by directing the respondent no. 2 to consider and dispose of the representation dated 20.06.2024 within a period of eight weeks from the date of communication of this order.

3. It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided in accordance with law.

4. It is also made clear that grant or non-grant of electricity will not create any equity in favour of the private respondent and will not affect the civil rights which are pending before the competent Civil Court by and between the parties.
