1. Affidavit of service filed in Court today is taken on record.

2. Perused the report of the Zonal Medical Board comprising of the doctors of the Burdwan Medical College & Hospital dated 27th May, 2025.

3. The same mentions that the son of the petitioner, aged about six years, appeared before the Board and after conducting meticulous clinical examination he has been found to be a Beta-

Thalassaemia Carrier who is medically fit at present and requires no treatment presently.

4. The petitioner prays for transfer on the ground that his son is suffering from Thalassaemia and his son is required to continue with proper medical follow up for fighting the disease.

5. Reliance has been placed on the West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002 duly amended on 30th September, 2021, which specifically mentions that an applicant may seek transfer if the applicant or his child is suffering from Thalassaemia.

6. The report of the Medical Board clearly asserts the fact that the son of the petitioner is a Beta Thalassaemia Carrier. He currently does not require any treatment only because he is continuing with the regular check up with his doctors.

7. In view of the considered opinion of the Medical Board that the son of the petitioner is a Thalassaemia patient, accordingly, the prayer of the petitioner seeking transfer which is pending consideration at the end of the Secretary, West Bengal Board of Primary Education being the respondent no. 4 shall be decided and disposed of at the earliest but positively within a period of four weeks from the date of communication of this order.

8. If the prayer of the petitioner is allowed, then all necessary follow up steps shall be taken by the aforesaid respondent.

9. Let a copy of the medical report of the Zonal Medical Board be forwarded to the aforesaid respondent at the time of communicating the order of the Court.

10. The writ petition stands disposed of.

11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
