Ms. Afreen Begum Mr. Mostafijur Rahaman Ms. Swastika Chowdhury ..for the petitioner Mr. Biswaroop Bhattacharya Mr. Pratik Majumder ..for the respondents The petitioner seeks to appear in the third Semester Examination of "Mass Communication and Journalism" conducted by Rabindra Bharati University scheduled to start from tomorrow.

It is submitted that the petitioner due to some health issues, she could not attend the university regularly and, therefore, the university decided not to allow her to sit in the said examination.

The university submits that the petitioner had only 35 per cent attendance and under the relevant regulations, it is mandatory to have at least 75 per cent attendance for each semester. It has further been submitted that the internal assessment of the petitioner

also could not be made due to her absence in the university.

The attendance of the petitioner is too low to take a sympathetic view in her favour particularly when the university submits that there is no provision for condonation of shortage of attendance.

It appears that if the petitioner is not allowed to take her third Semester Examination this time, she will be entitled to appear in the said examination in the coming year in the month of January subject to fulfilling other criteria.

In that view of the matter, decision not to allow the petitioner to take part in the upcoming third Semester Examination is not interfered with.

Accordingly, WPA 1138 of 2024 is dismissed.
