1. Affidavit of service, as filed, be kept with the record.

2. The petitioner is aggrieved that the sale of the mortgaged property has been done illegally as the declaration of his loan account as a Non-Performing Asset was beyond the parameters set forth by the Reserve Bank of India guidelines.

3. Ms. Roy Choudhury, learned Advocate appearing for the Bank, submits that the sale has already been held and confirmed sometime in 2025. The sale has not yet been challenged. In fact, the sale has not been challenged in this petition as well.

4. The petitioner has an alternative and efficacious remedy and indeed a statutory remedy available to him, which he has to avail before approaching the Writ Court.

5. In view thereof, WPA 1472 of 2026 is dismissed. No order as to costs.
