Mr. Prasun Kumar Dutta, Mr. Goutam Wilson ....For the State Apprehending arrest in connection with Chopra Police Station Case No. 221 of 2019 dated 20.03.2019 under Sections 341/323/324/325/326/307/354 of the Indian Penal Code, the petitioner has filed the present application. Mr. Chowdhury, learned advocate appearing for the petitioner submits that there was a land dispute between the petitioner and the de facto complainant and the petitioner has been falsely implicated. Upon conclusion of investigation, charge sheet has also been filed and in view thereof, the petitioner may be granted anticipatory bail subject to any strict condition that may be imposed.

Mr. Dutta, learned advocate appearing for the State opposes the petitioner's prayer and draws our attention to the injury reports and the statements of the injured persons recorded under Section 161 of the Code.

Having heard the learned advocates and considering the materials in the case diary, the gravity of the offence and the injury report, we are not inclined to exercise any discretion in favour of the petitioner. As such, his prayer for anticipatory bail is refused.

Accordingly, the application for anticipatory bail, being CRM No. 519 of 2021, is rejected.
