Mr. Avirup Chatterjee ...for the petitioner By this application the petitioner has prayed for a direction upon the learned Civil Judge (Sr. Divn.), 1st Court at Barasat to dispose of Title Suit No.344 of 2013 expeditiously.

However, in course of argument of this civil revision application the learned advocate appearing for the petitioner submits that the petitioner is now praying for a direction upon the learned Trial Judge to dispose of the application under Section 151 of the Code of Civil Procedure which is pending since June 9, 2022. On a query of this Court the learned advocate appearing for the petitioner submits that the said application is otherwise ready for hearing.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates representing them before the learned Trial Judge.

In the light of the submission made by the learned advocate for the petitioner, CO 188 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Divn.), 1st Court at Barasat to take up the hearing of the application under Section 151 of the Code of Civil Procedure filed on June 9, 2022 on the next date fixed, if the same is otherwise ready for hearing, and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
