Court no. 34

IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 115 of 2020 CRAN 1 of 2020(Old CRAN 384/2020) In the matter of : Ivan Rojario @ Ivan Rojrio @ Ivan Rozario @ Ivan Rajoria ...petitioner. In Re : An application under Section 482 of the Code of Criminal Procedure.

Mr. Danish Haque Mr. Sharequl Haque ......for the petitioner.

Mr. Swapan Banerjee Ms. Purnima Ghosh ....for the State.

Re : CRAN 1 of 2020 The reasons so assigned in the application filed under 5 of the Limitation Act do not appeal to this court to be justified for interference at this belated stage. The condonation of delay of 580 days in preferring the revisional application and the reasons so assigned are grounds of health of the father of the petitioner as also the fact that the

certified copy which was taken out from the learned trail court was not upto the date.

Charge was framed in the year 2018 and the trial of the case could not proceed because of the pendency of the revisional application. Having regard to the delay of one and half years in preferring the revisional application from date and the charge has been framed, I am of the view that the grounds so narrated are not justified for interference by this court in a criminal trial.

Accordingly, the application being CRAN 1 of 2020(Old CRAN 384/2020) is dismissed.

Consequently, the revisional application being CRR 115 of 2020 is dismissed.
