Mithun Miya @ Mithun Mia v. State Of West Bengal
AD 35 February 13, 2026 Ct. 28 SG CRM(A) 251 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Farakka P.S. Case No.384 of 2024 dated 12.11.2024 under Sections 179/180/3(5) of the BNS, 2023. And In the matter of: Mithun Miya @ Mithun Mia ... petitioner Mr. Mrityunjoy Chatterjee Ms. Suchismita Chakraborty Mr. Debarnab Adhikary ... for the petitioner Ms. Sonali Das Mr. Santanu Talukdar ... for the State Learned counsel for the petitioner submits that the only material available against the present petitioner is the statements of two co-accused.
Learned counsel for the State opposes the prayer for anticipatory bail, files a report which is taken on record, relies on the case diary and submits that one co-accused was arrested with fake currency notes to the tune of Rs.2,44,500/-. The petitioner's name transpired from his statement. Apart from this, there are conversations between the present petitioner and the principal accused at the relevant time. There is also a criminal antecedent against the present petitioner, although not involving the same offence.
Considering the above and the other materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
