Nirmal Kr. Samanta v. State Of West Bengal & ORS.
31.08.2023 ss W.P.A. 231 of 2019 Nirmal Kumar Samanta Vs.
The State of West Bengal & ors.
< Mr. Saikat Sutradhar Mr. Sagar Dey Mr. Sutirtha Nayek ... for the petitioner Mr. Ratul Biswas Mr. Kaushik Choudhury ... for the Board This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in providing the information as sought by him under the Right to Information Act, 2005. Direction for affidavits has been given in this matter but no such affidavit has been filed by the respondent authorities.
Counsel on behalf of the petitioner fairly submits that the petitioner has received all the information except the marks obtained by him in the interview process and accordingly, he prays to provide the same. In my view, the respondent authorities are directed to provide only the information of the marks obtained by the petitioner in the interview process, since he has already received the other information as per
applications dated August 9, 2017 and December 9, 2017, within a period of three weeks from date. With the above directions, this writ petition is disposed of.
All parties are to act on website copy of this order. ,, (Shekhar B. Saraf, J.)
