Petitioner/State of West Bengal has prayed for cancellation of bail. However, the report submitted by the Inspectorin-Charge, Katwa Police Station reflects that the learned trial court on 17th February, 2024 was pleased to issue warrant of arrest and started proceedings against the surety under Section 446 of the Code of Criminal Procedure so far as the opposite party is concerned. Report also reflects that the trial court has completed the examination of prosecution witness and has fixed date for examination of the accused persons under Section 313 of the Code of Criminal Procedure when the present opposite party started evading the court. Report so submitted by the State be kept with the record.
In view of the present stage of the proceedings, the following directions are being passed:-
(1) The Officer-in-Charge, Missing Persons Bureau, Bhawani Bhawan, CID, West Bengal will scan and try to trace out the whereabouts of the accused Monai @ Monar Ali Sk. @ Mona who is evading the
court in connection with Sessions Case No.102 of 2021 (Katwa Police Station Case No.204 of 2017).
(2) Immediately on receipt of information, the Officer-inCharge, Missing Persons Bureau would inform the Inspector-in-Charge, Katwa Police Station for executing the warrant of arrest.
(3) Efforts be taken by the concerned Department of the CID, West Bengal to complete the process within a period of 15 days and allow the Inspector-in-Charge, Katwa Police Station to take steps for apprehending the accused.
(4) As the learned trial court has started proceedings under Section 446 of the Code of Criminal Procedure against the accused and issued warrant of arrest, the earlier bail so granted is deemed to be cancelled. With the aforesaid observations, CRR 232 of 2024 is disposed of.
Pending connected application, if any, is consequently disposed of.
