Apprehending arrest in connection with Chapra P. S. Case No. 506 of 2020 dated 17.12.2020 under Sections 341/325/326/307/427/34 of the Indian Penal Code and Sections 25/27 of the Arms Act, the petitioners have filed the present application.

We have perused the merits of the case so far as the complaint and the statements of the relevant witnesses are concerned, the injury reports and the G.D. Entries for registration of the FIRs, being G.D. Entry no.1065 dated 17th December, 2020 in respect of Chapra P. S. Case No. 505 of 2020 dated 17.12.2020 and G.D. Entry no.1066 dated 17th December, 2020 in respect of the instant case.

Having regard to the substantial facts of the case, which was registered on the basis of the complaint of one Parvina

Mondal, we are of the opinion that the present case has been initiated on the self-same facts and is in the nature of a subsequent FIR.

In view of the aforesaid, the petitioners' prayer for anticipatory bail is allowed.

Accordingly, in the event of arrest the petitioners, viz. Rajive Sk. @ Rajib Sk. and Ranju Sk., shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. The application for anticipatory bail, being CRM 543 of 2021, is, thus, disposed of.

Let case diary be returned to the learned advocate appearing for the State.
