The department has placed this matter for certain clarification.

It is clarified that by the order dated 10th June, 2025, FA 32 of 2016 was disposed of.

TCR shall be sent down to the learned Trial Court at the earliest.

We also clarify that the impugned judgment and decree is set aside.

However, there is a typographical error crept in the order dated 10th June, 2025.

In 8th line from the top of paragraph 2 at page 2 of the order transcribed under CAN 5 of 2023 in FA 32 of 2016, instead of 'necessary parties", it has been typed as "necessary patties".

Let this correction be incorporated in the order dated 10th June, 2025.

We request the learned Trial Judge to dispose of the partition suit as expeditiously as possible.

9.

The earlier order dated 10th June, 2025 is clarified to the aforesaid extent.

10. This order shall form part of the order dated 10th June, 2025.
