It has been submitted by the petitioner that despite tendering apology in terms of the order dated January 11, 2023, the petitioner has not been permitted to appear in the examination which is scheduled on January 17, 2023.

It has been submitted by Mr. Ahamed, learned advocate appearing for the petitioner that though initially the apology letter was not in terms of the settlement arrived at on January 5, 2023, subsequently a further letter of apology was tendered upon the University authority.

Mr. Chatterjee, learned advocate appearing for the University submits that the apology letter was not

in terms of the order passed by this Court on January 11, 2023.

The University will consider the apology letter tendered through e-mail on January 15, 2023 to the Proctor, Visva-Bharati, as appearing at page 39 of the writ petition. If the University satisfies with the apology letter, dated January 15, 2023, it may allow the petitioner to sit in the examination. I leave it to the University authority to consider and take a decision after considering the e-mail dated January 15, 2023. With the aforesaid observation, WPA 1234 of 2023 is disposed of.

There will be no order as to costs.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
