Learned advocate appearing for the petitioner submits that it is the petitioner only who is appearing and participating in the proceedings in connection with Muchipara Police Station Case No. 120 of 2021 and rest of the accused persons are absconding.

Learned Metropolitan Magistrate, 19th Court, Calcutta is directed to exhaust the process of law in respect of the absconding accused persons and take steps for serving the copies under Section 207 of the Code of Criminal Procedure upon the present petitioner viz. Eugene Ohara Lotha @ Eugene Ohara Yanthan. After the process is complete, the learned court would split up the case and allow the petitioner to take up the issues he intends to agitate at the stage of consideration of charges. Learned trial court would see to that the said process is completed within a period of six months.

With the aforesaid observations, the revisional application being CRR 229 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
