Rejected that the petitioner is no way related and has been falsely implicated on the basis of afterthought statement. The petitioner was in an embellished manner identified in the T.I. Parade and the child who has identified the present petitioner, in fact, divulged the incident after a considerable period of time when the investigation was at the midway. It has also been submitted that in the FIR or the written complaint on the basis of which the case was initiated the petitioner's name did not transpire and subsequently at the time of submission of the charge-sheet the petitioner has been named. Learned advocate for the petitioner submits that since the investigation has been completed and there are many discrepancies, petitioner may be released on bail on any stringent conditions. Learned advocate for the State draws the attention of the

Court to the statement of the child as well as the T.I. Parade. I have taken into account the postmortem report also. Having regard to the totality of the circumstances and the fact that the charges have already been framed and witness action is about to commence, at this stage, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM(M)199 of 2026 is rejected.
