Matter was first taken up on 13th February, when writ petitioner was represented. It was contended on behalf of the petitioner that he participated in 7th State Level Selection Test (AT) 2023 for being appointed as Assistant Teacher in English in madrasah.
According to the petitioner he answered rightly to question no. 27 under question booklet series B and which matched with the provisional key answer wherein it was indicated that correct answer was option C to question no. 27 but in final answer key correct option was declared as A instead of C to question no. 27 under question booklet series B.
Having considered such contentions made on behalf of the petitioner as well as learned
advocate representing West Bengal Marasah Service Commission Court directed vide order dated 13th February, 2025 to file an affidavit explaining what was the reason for changing answer to question no. 27 under question booklet series B by publishing final answer key and the report of the expert was also directed to be produced before this Court.
A report was filed in terms of the order dated 13th February, 2025 on 11th March, 2025 in the form of affidavit by the West Bengal Madrasah Service Commission. In addition thereto report of the subject expert is placed before this Court and same is taken into consideration.
Unfortunately, petitioner did not appear subsequently on 11th March, 2025 and 19th March, 2025. By order dated 19th March, 2025 Court directed the learned advocate for the West Bengal Madrasah Service Commission to send a notice within a particular time to the learned advocate representing the petitioner. Accordingly, notice dated 20th March, 2025 was served upon the learned advocate for the petitioner but in spite of service of notice petitioner is not represented today.
Having considered the submissions made on behalf of the Commission and the State respondents it appears that identical issue has
already been decided by this Court relying upon the affidavit affirmed on behalf of West Bengal Madrasah Service Commission and the report of the subject expert wherein candidate appeared in 7th SLST (AT), 2023 in English for being appointed as Assistant Teacher in madrasah. In view of the issue decided by this Court in WPA 413 of 2025 (Samiun Islam Gazi vs. The State of West Bengal & Ors.) issue in this present writ petition need not be dilated further. The view expressed by this Court in Samiun Islam Gazi (supra) covers the issue involved in this writ petition.
Let a copy of the order dated 17th March, 2025 passed by this Court in Samiun Islam Gazi (supra) duly countersigned by the Assistant Registrar of this Court be retained on record. In view of the issue decided by this Court in Samiun Islam Gazi (supra) present writ petition stands dismissed.
Report of the subject expert is returned to the learned advocate representing West Bengal Madrasah Service Commission.
