It has been submitted by the petitioner that despite tendering apology in terms of the order dated January 11, 2023, the petitioner has not been permitted to appear in the examination which is scheduled to commence from January 17, 2023.

It has been submitted by Mr. Ahamed, learned advocate appearing for the petitioner that though initially the apology letter dated January 12, 2023 was not in terms of the settlement arrived at on January 5, 2023, subsequently a further letter of apology was tendered before University authority on January 15, 2023.

Mr. Chatterjee, learned advocate appearing for the University submits that the said apology letter was

also not in terms of the order passed by this Court on January 11, 2023.

The University will consider the apology letter tendered through e-mail on January 15, 2023 to the Proctor, Visva-Bharati, as appearing at page 39 of the writ petition. If the University is satisfied with the said apology letter, dated January 15, 2023, it may allow the petitioner to sit in the examination. I leave it to the University authority to consider the issue and take a decision after considering the e-mail dated January 15, 2023.

With the aforesaid observation, WPA 1234 of 2023 is disposed of.

There will be no order as to costs.
