Kausik (Rejected) CRM (NDPS) 142 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Police Station Case No. 1253 of 2025 dated 17.06.2025 under Sections 21(C)/29 of the NDPS Act, 1985.

Learned advocate for the petitioner submits that petitioner is a lady who has a child and is in custody for about more than 7 months. The trial of the case is being delayed because of an absconding accused.

Learned advocate for the State submits that harsher process of law has been issued and would be exhausted in due course of time.

Having regard to the quantum of seizure, I am of the view that the provisions of Section 37 of the NDPS Act is attracted.

As such the prayer for bail of the petitioner is rejected.

Learned Trial Court would, after exhausting the process so far as the other accused person is concerned, try to split up the trial preferably within a period of 60 days from the date of communication of this Order and proceed with the trial of the case after consideration of the charges in accordance with law. With the aforesaid observations, at this stage, CRM (NDPS) 142 of 2026 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
