The grievance raised by the petitioner pertains to the failure on the part of the CESC Limited to provide an electricity connection at the premises of the petitioner. In compliance with the order of Court the CESC Limited has filed a report highlighting that there is no alternative route for installation of the electricity connection and there is also strong resistance by the private respondents.

In view of the disputes raised by the parties, I am of the view that the matter be decided by the concerned District Magistrate.

Such reference to the District Magistrate is in consonance with the Rule 3 of the Licenses Rules, 2006.

In view of the aforesaid the petitioner is directed to make a representation before the District Magistrate, South 24-Parganas within a period of two weeks from date. If such representation is made by the petitioner, the District Magistrate, South 24-Parganas is requested to consider and dispose of the representation of the petitioner within a period of 8 weeks from the date of receipt of such representation and after giving an opportunity of hearing

to the petitioner and all affected parties including the CESC Limited.

With the aforesaid direction WPA No. 561 of 2020 is disposed of.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
