Mr. Rajarshi Mitra Mr. Supratick Syamal ..for the petitioner The Sub Divisional Officer, Diamond Harbour Sub Division, shall treat the writ petition as a representation and dispose of the same by passing a reasoned order. It appears that the petitioner was one of the three selected candidates for the post of Asha.

The Block Development Officer intimated the District Magistrate, South Parganas that probably due oversight, the appointment letter to the petitioner and one Sakera Bibi had not been issued. According to the Block Development Officer, the petitioner was eligible to be appointed to the post of Asha in respect of the then existing vacancies in Ramchandrapur Sub-centre.

As the selection process was concluded in 2008, this Court cannot pass any mandatory directions. It appears that the petitioner slept over her rights for a long period of time. Moreover, whether there are any existing vacancies in the concerned sub centre is also the subject matter of

doubt. The selection list cannot be revived at this stage, by the Writ Court. However, the petitioner is entitled to know the reasons as to why she was not granted appointment to the post of Asha in respect of Ramchandrapur Sub centre although she was found to be eligible by the Block Development Officer, Mandirbazar, South 24 Parganas.

The Sub Divisional Officer, Diamond Harbour Sub Division, shall intimate the petitioner the reasons for not granting appointment to the petitioner within a period of four months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
