Mr. Rudradipta Nandy ... For the State. Apprehending arrest in connection with Bhatpara Police Station Case No. 33 of 2019 dated 11.07.2020 under Sections 306/34 of the Indian Penal Code, the present application has been filed.

Mr. Mitter, learned advocate appearing for the petitioners submits that the petitioners are innocent of charges and they have no role in the abatement in commission of suicide of the victim.

Additionally, learned advocate for the petitioners submits that on any stringent condition, the petitioners may be allowed to release as prayed for.

Mr. Nandy, learned advocate appearing for the State draws the attention of this court to the statement of the witnesses as recorded in the case diary.

We have perused the materials on record in the case diary and having regard to the fact that the relationship was terminated at the instance of the guardian, the custodial detention in this case may not be warranted so far as the present petitioners are concerned and as such, the anticipatory bail prayer of the present petitioners are allowed.

Accordingly, we allow the application for anticipatory bail and direct that in the event of arrest, the petitioners, namely, Vishal Vikash Ekka @ Bishal Bikash Ekka, 2. Barkha Rejeen Ekka @ Baby Ekka, 3. Saroj Mary Ekka shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail, being CRM 555 of 2021 is, thus, disposed of.
