(Via Video Conference) It appears from record that the writ petition was listed on 26.06.2009 and the petitioner seeks an adjournment, accordingly, the matter was adjourned. Again on 1.12.2009 the matter was listed but none had appeared on behalf of the petitioner and this Court has sent the matter out of the list with the liberty to mention upon notice to the respondent. The matter was sent for settlement before the National Lok Adalat but as the per the report of the High Court Legal Service Committee none of the parties have appeared before the National Lok Adalat and accordingly the case record has been returned to this Court.

Again the matter was listed on 23.11.2021 but none had appeared on behalf of the petitioner and in the interest of the justice, the case was adjourned till today. Again today none had appeared on behalf of the petitioner. It appears from record the petitioner is not interested to proceed with the matter.

Hence the writ petition being WPA 149 of 2009 is dismissed for default.
