Petitioner Mr. Priyankar Ganguly ...for the petitioner Mr. Subhamoy Bhattacharya Mr. Sharequl Haque ..for the State Learned counsel appearing on behalf of the petitioner submits that other than the statements of the co-accused, there is no other incriminating material available in the case diary. Charge sheet has been submitted.

Learned counsel appearing on behalf of the State submits that there are phone call conversations between the petitioner and the principal accused at the relevant time.

Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
