The State of West Bengal and others Mr. Sujit Bhunia ... for the petitioners Mr. Sirsanya Bandopadhyay Mr. Ritesh Ganguly ... for the State Affidavit of service filed in Court is taken on record. Learned counsel for the petitioners submits that the respondent No.9 refused to accept service. The petitioners have alleged in their representation dated 08.11.2023 about removal of unauthorised encroachment on public road. The land actually belongs to the Irrigation and Waterways Department. Till date such representation has not been considered by the respondent No.4.

Learned counsel for the State denies the allegations and submits as follows. First, the Irrigation Department has not indicated any encroachment on the said land. However, a survey is going on in respect of the mouza. It appears that the petitioners' representation made in the year 2023 has not been considered yet.

In view of the above, let the respondent No.2 consider the petitioners' representation dated 08.11.2023 in accordance with law and upon hearing the concerned parties as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order.

It is clarified that the merits of the case have not been gone into.

Accordingly, the writ petition is disposed of. Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
