By presenting this writ petition, petitioner has prayed for release of arrear dues which is accrued due to sanction of post graduate scale of pay in his favour vide memo dated 7th October, 2021 issued by the District Inspector of Schools (SE), Murshidabad being respondent no.3.

On perusal of the said memo dated 7th October, 2021 sanctioning post graduate scale of pay in favour of the petitioner, it appears that such benefit was allowed with effect from 1st July, 2008. However, it is submitted on behalf of the petitioner that pay of the petitioner has been refixed in post graduate scale of pay with effect from 1st March, 2021 ignoring claim of the

petitioner to receive arrear dues from 1st July, 2008 which triggered present writ petition.

In view of memo dated 7th October, 2021 it is apparent that petitioner is entitled to receive arrear dues for sanctioning higher scale of pay with effect from 1st July, 2008.

State respondents are represented by learned Additional Government Pleader who submits that the concerned District Inspector of Schools is authorized to take steps to release arrear dues.

In view of aforesaid submissions made on behalf of the parties and taking note of the sanctioning memo dated 7th October, 2021 granting post graduate scale of pay with effect from 1st July, 2008, writ petition stands disposed of directing the District Inspector of Schools (SE), Murshidabad, being respondent no. 3 to release arrear dues in favour of the petitioner for sanctioning post graduate scale of pay from 1st July, 2008 till February, 2021 by eight weeks from the date of communication of this order, if same has not been paid till date. There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
