Learned advocate appearing for the petitioner has drawn the attention of the Court to the conduct of the opposite party no.2 who is negotiating with the orders passed and is attempting to stagnate the execution case. Records reflect that in M.E.X. Case No. 306 of 2021 which is pending before learned Judicial Magistrate, 1st Court, Alipore, the petitioner is cryptically making payments. Learned advocate appearing for the petitioner submits that the execution case was filed for recovery of a sum of Rs.38,500/- which accrued with passage of time. Till date, the opposite party, according to the petitioner, has paid only Rs.14,100/-. The payments are made cryptic and the opposite party is also not paying the regular amount of maintenance.

The residuary amount remaining in the execution case should be cleared by the opposite party in two instalments by 15.03.2024. Thereafter, the petitioner would be at liberty to take steps regarding the quantum relating to the award of maintenance which the opposite party is liable to pay. With the aforesaid observations, the revisional application being CRR 237 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
