The petitioner was suspended from service as an Assistant Teacher from March 10, 2008 to July 5, 2022. The suspension was in view of criminal proceedings against him.

The petitioner was reinstated and he joined service on July 6, 2022, after suspension was revoked by order dated July 4, 2022. The petitioner has represented on July 31, 2023 for the 10 and 18 years service benefit.

It is submitted by the learned counsel for the petitioner that the trial has been completed and judgement is yet to be delivered.

Mr. Bhaskar Prasad Vaisya, learned counsel for the DPSC, North 24 Parganas submits that if the petitioner is convicted in any

criminal proceeding, he may not be entitled to any benefit whatsoever.

In those circumstances, this Court directs the respondent no. 4 to consider the petitioner's representation and dispose of the same in accordance with law, within a period of 2 months from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
