Petitioner is a gold smith. He contends he had undertaken appraisal work in respect to pledged gold against which loans were advanced. In order to cover up the role of the bank officials he has been falsely implicated. Accordingly, he prays for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. We have also gone through the directions issued by the bank with regard to appraisal of pledged gold. As per regulations, duty was cast upon the appraiser to undertake appraisal of pledged gold by three methods and to come to a finding. It appears petitioner did not follow the said regulations and gave incorrect report. Whether a second appraisal was intentionally avoided may be a matter of investigation qua role of bank officials but it does not dilute the involvement of the petitioner in the crime.

Keeping in mind the aforesaid facts which disclose involvement of the petitioner in enabling sanction of loan by the bank against fake gold pledged, we are of the opinion this is not a fit case to grant anticipatory bail.
