In Re: An application under Section 482 of the Code of Criminal Procedure, 1973;

Pankaj Saraf and another

Versus

State of West Bengal and another None appears on behalf of the petitioners.

The proceedings before the learned Judicial Magistrate, 2nd Court, Katwa has been challenged before this Court. In the said proceedings being Complaint Case No.C/138 of 2020 learned Magistrate was pleased to issue process under the provisions of Section 138 of the Negotiable Instruments Act. The present petitioners by producing certain photostat copies of documents pray for quashing of the proceedings. Having regard to the nature of the documents so produced before this Court, I am of the opinion that this Court is not empowered to conduct any mini trial and the points so canvassed in the revisional application are to be advanced before the learned Judicial Magistrate at the appropriate stage. No interference is called for.

With the aforesaid observations, CRR 120 of 2021 is disposed of.
