Mr. Biswarup Nandy, Mr. Rajesh Kumar Shah ....for the petitioners Mr. Pantu Deb Roy, ld. A.G.P., Mr. Anand Farmania ....for the State Affidavit of service filed in Court today is taken on record.

Despite several notices, the private respondents are not represented.

The petitioners complain of physical torture and mental harassment by the private respondents, their son and daughter-in-law. The petitioners complain that the son and daughter-inlaw have forcibly evicted them from the said premises.

This Court notices that the police have taken steps under Section 107 of the Cr. P.C.

Despite whereof, the torture of the son and daughter-in-law are continuing.

The Officer-in-Charge, Haripal Police Station shall immediately restore the possession of the petitioners back into the premises. The O.C. shall

also summon the son and daughter-in-law and issue appropriate warnings against inflicting any torture or intimidating the petitioners.

The Haripal Police shall immediately take action upon any further complaint from the petitioners as regards the forcible eviction by the private respondents.

If it is found that the private respondents are continuing with their torture on the petitioners, suitable steps including detention and eviction of the son and daughter-in-law from the said premises, shall be taken by the Haripal Police Station.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

Leave is granted to the petitioner to correct the cause title in course of the day.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
