Mr. Mortoj Ali ... For the petitioners This application under Article of the Constitution of India relates to a prayer for expeditious disposal of an injunction application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure pending before the learned Civil Judge (Junior Division), 1st Court, Alipore, South 24-Parganas.

Considering the nature of prayer, i.e., expeditious disposal, I find hardly any necessity to ask for service of notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with. The learned Civil Judge (Junior Division), 1st Court, Alipore, South 24-Parganas, is requested to dispose of the injunction application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, preferably within one month from the date of receipt of this order after hearing both sides and without granting any unnecessary adjournment to either of the parties in any case, save and except extreme urgency.

With the above observation, the revisional application, being CO 174 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioners is at liberty to bring this order to the notice of the learned Civil Judge (Junior Division), 1st Court, Alipore, South 24-Parganas,, forthwith.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
