The petitioner is aggrieved by the fact pursuant to an information furnished with Dum Dum Police Station being the complaint dated 24.12.2024 a case was registered as FIR being Dum, Dum P. S. Case No. 468 of 2024 under Section 303(2) of the BNS.
The further grievance of the petitioner is that although case has been registered, there is no progress of the investigation of the case.
Learned advocate for the State has submitted a report prepared by the Inspector of Police, Dum Dum Police Station wherefrom it reflects that the police authorities have recorded the statement of the witnesses, issued notice under Section 94 of the BNSS pursuant to which the documents have been handed over to the Investigating Officer by the petitioner in support of her claim regarding jewellery. Notices were served upon the persons named in the FIR dated 24.12.2024. Prima facie it reflects that the police authorities are taking steps but they are unable to recover jewellery till date.
Having regard to the steps taken by the police authorities till date when the investigation has commenced only on 24th December, 2024, I am prima facie of the view that the police authorities/Investigating Agency have been taking steps in accordance with law.
However, the police authorities, if required, would seek assistance of the superior officer for tracing out the mode and manner in respect of similar offences in the area concerned for the purpose of recovery of the jewellery which is the subject matter of the present writ petition.
With the above observation WPA 1476 of 2025 stands disposed of.
