......Petitioners Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha ....For the Petitioners Mr. Anwar Hossain Ms. Sima Biswas .......For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Nazat Police Station Case No. 15 of 2020 dated 20.01.2020 under sections 21(c)/29 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (Case No. N-22 of 2020) . The learned advocate appearing for the petitioners submits that the petitioners are in custody since 20th January, 2020. Additionally, the learned advocate submits that as there has been no progress in the case, the petitioners may be released on bail on any stringent condition.

The learned advocate appearing for the State opposes the prayer for bail on the ground that 10 litres of codeine mixture were seized from the possession of the petitioners. We have assessed the materials on record and we are of the opinion that the provisions of section 37 of the N.D.P.S. Act

are attracted in this case. As such, the prayer for bail of the petitioners is rejected.

As it has been informed to us that the next date is fixed in the month of May, 2021 for consideration of charge, we direct the learned Trial Court to expedite the progress of the trial and conclude the same within a reasonable period of time. With the aforesaid observations, the application for bail, being CRM 571 of 2021, is disposed of.
