Mr. Ramashish Mukherjee Mr. Amit Pan Mr. Abhrajit Roy Chowdhury .................for the petitioner The petitioner, Sampita Das (nee Sadhukhan) filed an application under the relevant provisions of PWDV Act, 2005 on or about 22.12.2020. The grievance of the petitioner is that her application for interim relief is pending since a considerable period of time.

She has neither received any relief in the proceedings under section 125 of the Code of Criminal Procedure nor any relief under the PWDV Act, 2005. The next date of the case is fixed before the learned Judicial Magistrate, 2nd Court, Barasat on 19.03.2024. Records of the revisional application reflect that the affidavit of assets and liabilities is yet to be filed by the opposite party no.2/husband.

Having regard to the period of time i.e. 3 years, which has expired, I direct the learned Judicial Magistrate, 2nd Court, Barasat to consider the interim prayers preferred in connection with Case No. C-1872 of 2020 by 15th April, 2024. If the affidavit of assets and liabilities is not filed by the opposite party on 19th March, 2024, an extension of time till 26th

March, 2024 be granted and the interim prayers so made before the learned Court be disposed of within the time scheduled, as stated above.

With the aforesaid observations, C.R.R. 290 of 2024 is disposed of.
