Masud ... for the State-respondent(s) The petitioners claim that they are attempted to be dispossessed from their lands, neither are they allowed to cultivate their lands at the behest of the respondent no.4 nor they are allowed to enjoy the said properties.

The further grievance of the petitioners is that in spite of informing the local police station, no action has been taken.

Mr. Ahmed, learned advocate for the State, has submitted a report, which reflects that the police authorities have already drawn up a proceeding under Sections 126/135(3) of the BNSS.

So far as the right, title and interest of a property is concerned, it would be the exclusive domain of the learned Civil Court to decide the same.

In case, there is/are disturbance(s) at the behest of the private respondents to create obstruction in the cultivation, the petitioners would approach the jurisdictional Civil Court for appropriate relief(s) by invoking the relevant provisions of the Code.

So far as the law and order is concerned, the police authorities as they have been keeping strict vigil, they would continue their surveillance and ensure that no breach of peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 1543 of 2025 is disposed of.
