Mukherjee Mr. Somnath Naskar .... For the State The petitioners complain that their shop room which is the subject matter of Title Suit No. 54/2018 has been locked. They seek assistance of the police to open the lock. The petitioners approached this Court in W.P.A.17062 of 2022 and the said writ petition was disposed of by an order dated 7th September, 2022 where the property rights of the petitioners were left to be agitated. In the said civil suit admittedly the petitioners are enjoying injunction against dispossession. This Court has also protected the petitioners against dispossession albeit subject to the result of the civil suit.

The question of entertaining any further prayer or any relief in respect of the subject matter of the suit cannot be entertained in the writ petition.

The writ petition stands dismissed.

There will be no order as to costs.
