The learned advocate for the petitioner submits that the petitioner is in custody from 22nd of April, 2020 and till date there is no progress in the trial. Charge-sheet has been submitted.

Ms. Sur, learned advocate for the State opposes the prayer for bail and submits that above commercial quantity of brown sugar (3Kg. 360 gms.) were seized from the possession of the petitioner and another.

Having regard to the fact that the contraband, so seized, is of commercial quantity, we are of the opinion that Section 37 of the NDPS Act is attracted. As such, the petitioner is not entitled to be released on bail at this stage.

Learned Trial Court is directed to expedite the process of consideration of charge and thereafter proceed with the trial of the case and conclude the same within a reasonable period of time.

With the above observations, CRM 584 of 2021 is rejected. (Tirthankar Ghosh, J.) (Tapabrata Chakraborty, J.)
